General Terms & Conditions

ARTICLE 1 - DEFINITIONS

In these General Conditions, the following shall be understood as:

  • Cooling-off period: the period within which the consumer may exercise his or her right of withdrawal for online purchases from margaret-made.com;

  • Consumer: a natural person who is not acting in the exercise of a profession or business and enters into a distance contract with Margaret Made;

  • Fixed-term transaction: a distance contract relating to a series of products (e.g., subscription boxes of handmade items) whose delivery obligation extends over time via margaret-made.com;

  • Durable data medium: any medium that allows a consumer to store information (e.g., order confirmations) from margaret-made.com in a manner that allows future consultation and unaltered reproduction;

  • Right of withdrawal: the consumer's right to withdraw from an online purchase on margaret-made.com within the reflection period;

  • Entrepreneur: Margaret Made, the entity offering handmade and unique products to consumers remotely via margaret-made.com;

  • Distance contract: an agreement under which, within the framework of Margaret Made’s system for the online sale of products on margaret-made.com, exclusive use is made of distance communication techniques (e.g., website, email);

  • Distance communication technique: A means (e.g., website checkout or email confirmation) used to conclude an agreement without the consumer and Margaret Made being in the same room;

  • General conditions: these general conditions of Margaret Made for purchases on margaret-made.com.

ARTICLE 2 - COMPANY IDENTITY

ARTICLE 3 - APPLICATION

These general terms and conditions apply to all offers from Margaret Made and to all contracts and online orders concluded between Margaret Made and the consumer via margaret-made.com.

Before the conclusion of the distance contract, the text of these general terms and conditions will be made available to the consumer on margaret-made.com. If this is not reasonably possible, the consumer will be informed before checkout that the general terms and conditions are accessible online and will be emailed free of charge upon request to hello@margaret-made.com.

If the distance contract is concluded electronically on margaret-made.com, the text of these General Terms and Conditions will be made available during checkout in a downloadable format. If this is not feasible, the consumer will be directed to the terms page (https://www.margaret-made.com/pages/terms) before purchase, with an option to request a copy via email.

If product-specific terms (e.g., custom handmade items) apply in addition to these general terms, the second and third paragraphs shall apply accordingly. In the event of conflicting terms, the consumer may rely on the provision most favorable to them.

If any provision of these general conditions is void or voidable, the contract and remaining conditions will remain in force, with the void provision replaced by one aligning with the original intent.

Situations not covered by these conditions will be evaluated in the spirit of Margaret Made’s commitment to fair eCommerce practices.

Any ambiguity in the interpretation of these General Conditions will be construed in their spirit.

ARTICLE 4 - THE OFFER

If an offer on margaret-made.com has a limited validity period (e.g., seasonal handmade collections) or is subject to conditions, this will be explicitly stated on the product page.

The offer is non-binding. Margaret Made reserves the right to update or adapt offerings based on availability of handmade materials.

Each product page on margaret-made.com contains a complete description of handmade items (e.g., materials, dimensions), sufficient for the consumer to assess the offer.

If the merchant uses images, they are a faithful representation of handmade products like those sold on margaret-made.com. Obvious errors (e.g., pricing typos) are not binding.

All images and data on margaret-made.com are indicative and cannot be grounds for compensation or contract termination.

Product images reflect the handmade nature of items; slight variations in color or texture may occur due to craftsmanship.

Each offer on margaret-made.com includes: the price (excluding shipping and import fees where applicable), delivery costs, checkout process details, whether the right of withdrawal applies, payment methods (e.g., PayPal, credit card), estimated delivery times, and the option to review order details before finalizing. Optional details include available sizes or custom options.

ARTICLE 5 - THE AGREEMENT

The contract is concluded when the consumer accepts the offer on margaret-made.com and completes the checkout process.

If accepted electronically, Margaret Made will send a confirmation email to the consumer’s provided address. Until confirmation, the consumer may cancel the order.

Margaret Made ensures secure online transactions on margaret-made.com with encryption and safe payment processing.

The entrepreneur may verify the consumer’s payment ability before fulfilling orders. If concerns arise, Margaret Made may refuse an order, providing a reason (e.g., fraud risk).

The merchant will email the consumer (to the address provided at checkout) the order confirmation, return policy link (https://www.margaret-made.com/pages/returns), warranty information, and conditions for long-term contracts (if applicable), storable on a durable medium.

Each contract on margaret-made.com is subject to the availability of handmade products.

ARTICLE 6 - RIGHT OF WITHDRAWAL

Consumers purchasing from margaret-made.com have 30 days to withdraw without reason, starting the day after receiving the product.

During this period, the consumer must handle handmade items with care, unpacking only to assess them. If withdrawn, the product must be returned to Margaret Made with all accessories, in original packaging, following instructions at https://www.margaret-made.com/pages/returns.

To exercise this right, the consumer must notify hello@margaret-made.com within 30 days of receipt and return the item within 30 days, providing proof of shipment.

If the consumer fails to notify or return the item within these deadlines, the sale is deemed final.

ARTICLE 7 - EXPENSES IN CASE OF RIGHT OF WITHDRAWAL

The consumer bears return shipping costs for items purchased on margaret-made.com.

The merchant will refund the order amount (excluding shipping) within 14 days of receiving the returned item, pending verification, processed via the original payment method.

Refund processing may take up to 5 business days depending on the consumer’s bank.

ARTICLE 8 - EXCLUSION OF THE RIGHT OF WITHDRAWAL

The merchant may exclude the right of withdrawal for products on margaret-made.com if clearly stated before purchase, such as:

  • Custom handmade items made to the consumer’s specifications;

  • Perishable handmade goods (e.g., baked goods);

  • Sealed hygiene or personal care products opened by the consumer.

ARTICLE 9 - THE PRICE

Prices on margaret-made.com are fixed during the offer period, except for VAT changes.

Variable prices (e.g., due to material cost fluctuations for handmade items) will be noted on the product page.

Price increases within three months of purchase are only due to legal changes; after three months, consumers may cancel if notified of a price rise.

Prices exclude import fees where applicable, collected by the shipping provider. All prices are subject to typographical errors, with no liability for mistakes.

ARTICLE 10 - CONFORMITY AND WARRANTY

The merchant warrants that products on margaret-made.com meet contract terms, descriptions, and legal standards, reflecting their handmade nature.

Defective items must be reported to hello@margaret-made.com within 30 days, returned in original condition.

The warranty aligns with manufacturer terms but excludes liability for individual use suitability. It does not apply if the consumer modifies the item or if defects result from improper care.

ARTICLE 11 - DELIVERY AND EXECUTION

Margaret Made will handle orders on margaret-made.com with care, delivering to the shipping address provided at checkout.

Orders will ship within 30 days unless a longer period is agreed (e.g., custom items). If delayed, the consumer will be notified and may cancel, with a refund issued within 14 days.

If an item is unavailable, a similar handmade alternative may be offered, with return costs covered by Margaret Made.

Risk transfers to the consumer upon delivery.

ARTICLE 12 - CONTRACT CONDITIONS: DURATION, TERMINATION AND RENEWAL

Rescission

Consumers may terminate indefinite contracts (e.g., subscription boxes) with one month’s notice.

Fixed-term contracts (e.g., seasonal collections) may be terminated at the end with one month’s notice.

Renewal

Fixed-term contracts on margaret-made.com cannot be tacitly renewed unless for subscriptions, terminable with one month’s notice.

Duration

Contracts over one year may be terminated after one year with one month’s notice.

ARTICLE 13 - PAYMENT

Payments for margaret-made.com orders are due within 7 days of the cooling-off period start. The consumer must report payment inaccuracies promptly.

Late payments may incur reasonable fees as notified.

ARTICLE 14 - CLAIMS PROCEDURE

Complaints about margaret-made.com orders must be emailed to hello@margaret-made.com within a reasonable time, fully described.

ARTICLE 15 - LEGAL DISPUTES

Dutch law applies to contracts with Margaret Made, even if the consumer resides abroad.

ARTICLE 16 - EMAIL MARKETING

By agreeing to Email marketing from Margaret Made when checking out on margaret-made.com, you agree to receive recurring email messages (e.g., order updates, offers) even if on a do-not-call list. Message frequency varies. Consent is not a condition of purchase.
